Quick answer: Seven of the 62 Marine Protected Areas in the Southern Region allow recreational spiny lobster take: Anacapa Island SMCA, Anacapa Island FMCA, Cat Harbor SMCA, Crystal Cove SMCA, Dana Point SMCA, Painted Cave SMCA, and Kashtayit SMCA (which allows invertebrates generally, excepting rock scallops and mussels). The other 55 do not. Inside an SMCA nothing may be taken unless the rule names it, so a lobster is illegal in an SMCA that lists only finfish — and every State Marine Reserve, Federal Marine Reserve and no-take SMCA is closed to lobster outright.

California spiny lobster is regulated in exactly one place: CDFW’s Southern Region, from Point Conception to the Mexican border. That region also holds 62 of California’s Marine Protected Areas — more than any other. The overlap is the whole problem. The date of the opener is public knowledge; the line you are standing on at 6:05 p.m. is not.

Of those 62 MPAs, 7 allow recreational spiny lobster take. 55 do not.

The rule that catches people

An SMR (State Marine Reserve) is simple: no take of anything, ever.

An SMCA (State Marine Conservation Area) is where the tickets come from, because people read it as “partially open” and it is not. An SMCA prohibits everything its own rule does not explicitly allow. If the regulation for an SMCA lists recreational take of finfish by hook-and-line and says nothing about lobster, then lobster is prohibited there — not by an extra rule, but by the absence of one. Fifteen of the 21 SMCAs in the Southern Region work exactly that way.

Attempting to take counts as taking. A hoop net in the water inside a closed area is the violation, whether or not anything is in it when you pull.

The 7 where lobster take is allowed

MPAWhat the rule actually says
Anacapa Island FMCARegulations prohibit any harvesting, removing, taking, injuring, destroying, collecting, moving, or causing the loss of any Sanctuary resource, including living or dead organisms or historical resources, or attempting to do so EXCEPT that commercial and recreational lobster fishing and recreational fishing for pelagic finfish are allowed. Commercial fishing for pelagic finfish is prohibited.
Anacapa Island SMCARecreational take of spiny lobster and pelagic finfish is allowed. Commercial take of spiny lobster is allowed. Includes take exemptions for some tribes.
Cat Harbor SMCARecreational take of spiny lobster and sea urchin, squid by hook-and-line, and finfish by hook-and-line or spearfishing is allowed. Commercial take of sea cucumber by diving only, and spiny lobster and sea urchin is allowed.
Crystal Cove SMCARecreational take of finfish by hook-and-line or spearfishing and take of spiny lobster and sea urchin is allowed. Commercial take of sea urchin; spiny lobster by trap, and coastal pelagic species by round haul net, brail gear, and light boat is allowed. Take of living marine resources from tidepools is prohibited.
Dana Point SMCARecreational take of finfish by hook-and-line or spearfishing, and spiny lobster and urchin is allowed. Commercial take of spiny lobster by trap, sea urchin, and coastal pelagic species by round haul net, brail gear, and light boat is allowed. Take of living marine resources from tidepools is prohibited.
Painted Cave SMCARecreational take of spiny lobster and pelagic finfish is allowed.
Kashtayit SMCARecreational take of finfish, giant kelp by hand and invertebrates except rock scallops and mussels is allowed. Includes take exemptions for some tribes.

Two of these carry a catch worth reading twice. Anacapa Island appears three separate times in the MPA network — as an SMCA that allows lobster, as an SMR and an FMR that allow nothing, and as a Special Closure that bans setting any net or trap in under 20 feet of water. Same island, four different legal areas, and the one that allows lobster is not the one covering the whole island.

Kashtayit SMCA is the only one on the list that never says the word lobster. It allows recreational take of invertebrates except rock scallops and mussels, and a spiny lobster is an invertebrate that is not a rock scallop or a mussel. That is a correct reading of the rule as published, and it is also the kind of reading worth confirming with CDFW before you rely on it.

What it costs to get this wrong

Taking inside an MPA is not a warning offence. As an infraction it runs about $430 to $485 in total bail; charged as a misdemeanor it is $958 to $1,095. On top of either, every individual animal adds roughly $71 to $82. Seven lobsters over a line is not one ticket, it is one ticket plus seven surcharges — the arithmetic that turns an opener into four figures. The full breakdown is in what a California fishing citation actually costs.

Check the boundary, not the map you remember

The opener is 6 p.m. on a Friday in October. Most of the first session happens in the dark, and MPA boundaries are coordinates rather than anything you can see from the water. The areas that allow lobster are a small and scattered minority of a network that covers a lot of the best structure in Southern California, and several of them sit directly beside areas that allow nothing.

Creel carries all 157 California MPAs with their boundaries and the take rules for each, offline, so the answer does not depend on signal at the ramp.

Frequently asked questions

Can you take lobster in a Marine Protected Area in California?

In 7 of the 62 Southern California MPAs, yes. In the other 55, no. The type tells you most of it: every State Marine Reserve, Federal Marine Reserve, no-take SMCA and Special Closure prohibits it, and among the 21 regular SMCAs only 6 name lobster as allowed take. Kashtayit SMCA is the one that allows it without naming it, by allowing invertebrates generally except rock scallops and mussels.

What is the difference between an SMR and an SMCA for lobster?

An SMR (State Marine Reserve) is no-take: it is unlawful to injure, damage, take or possess any living marine resource, lobster included, with no exceptions for recreational fishing. An SMCA (State Marine Conservation Area) allows only the specific take its own regulation lists. That is the rule people get wrong — an SMCA is not "partially open," it is closed to everything the rule does not name. If the SMCA lists finfish by hook-and-line and says nothing about lobster, taking a lobster there is a violation.

Is it legal to set a hoop net inside an MPA?

Only where lobster take is allowed, and at Anacapa Island there is a separate gear rule on top: the Anacapa Island Special Closure prohibits setting any net or trap in water less than 20 feet deep. Setting a hoop net inside a reserve is take regardless of whether anything comes up in it, and wardens treat attempting to take as take.

What does it cost to be caught taking lobster inside an MPA?

Taking inside an MPA runs about $430 to $485 in total bail as an infraction, or $958 to $1,095 charged as a misdemeanor, plus roughly $71 to $82 for each individual animal. The per-animal surcharge is what turns a good night into a four-figure ticket.

How close to shore do MPA boundaries come?

Many run right to the beach, which is why shore-based hoop netters get cited as often as boats. Boundaries are legal coordinates, not landmarks you can see from the water in the dark, and the opener is at 6 p.m. on a Friday in October — most of the first session happens after sunset. Check the boundary before you leave, not from the rocks.
